A childcare worker is expected to face court on Tuesday afternoon for the alleged indecent assault of a two-year-old girl.

According to Fairfax Media, Max Rowe was nursing the toddler to sleep at a childcare centre in Sydney's inner west in May last year when a co-worker caught the 25-year-old committing the alleged act.

Police facts tendered to court allege Rowe was lying down with the toddler in the playroom helping the two-year-old get to sleep on May 13 when a co-worker left the room to make a phone call.

Upon returning to the playroom the co-worker alleges to have seen Rowe's hands on the girl's vagina area, on outside of her tights. The co-worker claims to have had a clear view for five seconds.

Max Rowe, 25, is expected to appear at Burwood Local Court on Tuesday afternoon.

"Upon the door opening, the accused very quickly moved his hand away from the victim and turned his head in the direction of the co-worker," police documents obtained by Fairfax at the court allege.

The co-worker reported the incident after notifying the childcare centre director and Rowe was charged by Child Abuse Squad detectives six days later.

Rowe has plead not guilty to the charge of indecent assault of a minor under 16, and accusations the 25-year-old used his position to abuse the toddler.

The childcare worker had access to children between the ages of two and five, working five days a week.

Rowe is expected to face Burwood Local Court on Tuesday afternoon after the hearing was adjourned on Monday.
